重庆女子被踢出845个工作群维权案终审胜诉，人社局通报已全额支付
9月1日，重庆市大足区人社局通报，针对近日引发关注的“小古”劳动纠纷，经核查，用人单位已于8月27日全额支付判决确定的费用。该案历经劳动仲裁、一审、二审，8月21日重庆市第一中级人民法院终审判决公司支付6.38万元。当事人“小古”对加班费认定有异议，已申请再审，并计划就社保、公积金等继续维权。

9月1日凌晨，重庆市大足区人力资源和社会保障局发布通报，回应近日引发关注的“小古”劳动纠纷。通报称，该局已联动相关部门组建工作专班核查处置。经查，2025年11月14日，“小古”因劳动关系、加班工资、经济补偿等争议申请仲裁，仲裁委确认劳动关系并裁决支付补偿。公司不服，起诉至区法院并上诉至市一中法院。2026年8月21日，市一中法院终审判决公司支付相关费用。8月27日，公司已全额支付。8月30日，人社局关注到“小古”网上发帖后，要求企业保障员工权益，并针对其新提出的社保诉求，将会同有关部门核处。
据封面新闻此前报道，8月31日，该事件登上热搜。当事人“小古”介绍，她2019年6月入职重庆一家传媒公司，2025年9月被老板口头调岗并要求休息三天，她拒绝后遭遇“冷板凳”：电脑被搬走、工位被摄像头对准、主管被禁止安排工作。2025年10月14日，她寄出《被迫解除劳动关系告知书》。她称被移出845个工作群，微信提示音响了一上午。
二审判决书显示，公司需支付63808.38元，包括工资、经济补偿金、未休年假工资1905.05元及2025年9月加班工资44.19元。裁判文书指出，因合同约定加班需书面审批，且小古每月签字确认工资表，故对2025年9月前的加班费不予支持。小古不认同，已于8月28日提交再审申请，并计划就公积金、社保等维权。
律师周兆成分析，公司孤立员工属违法变相辞退，可主张经济补偿；但签字确认工资表可能影响事后维权；单纯打卡记录不算有效加班证据，需留存公司安排加班的审批记录。
目前，人社局已通报相关情况，但社保诉求的核处结果尚待补充。
